Missoula restricts cannabusinesses around schools

Missoula has quietly made nearly a quarter of the city off limits to medical marijuana businesses.

As we report this week, the city implemented a policy in April restricting medical marijuana businesses from opening up shop near schools. The policy is based on the following state law:

45-9-109. Criminal distribution of dangerous drugs on or near school property — penalty — affirmative defense. (1) A person commits the offense of criminal distribution of dangerous drugs on or near school property if the person violates 45-9-101 in, on, or within 1,000 feet of the real property comprising a public or private elementary or secondary school.

The 1,000-foot buffer zones circling Missoula's roughly 30 elementary and secondary schools add up to 3,857 of the city's 17,879 acres, according to the Missoula City-County Office of Planning and Grants (OPG). See OPG's draft map on the right.
