Ryan Creek appeal rejected

The Montana Third Judicial District Court Friday upheld Granite County's denial of a 242-lot subdivision at Ryan Creek, hampering again a proposal that would establish a community "larger than Drummond" roughly 30 miles east of Missoula.
The court's decision will have no impact on concert activity at the new Ryan Creek Meadows venue established this summer by landowner and Missoula insurance agent Toby Hansen.
On July 9, the Indy reported that the subdivision was still tangled in two-year-old court proceedings. According to court documents, Hansen submitted his proposal for Phase I of large-scale housing and commercial project in May 2006, requesting Granite County's permission to develop 202 residential lots and 40 commercial lots. Granite County commissioners unanimously rejected the proposal on January 9, 2007.
From the court's final filing on the appeal: "Plaintiff's proposal was the largest proposal ever presented to Granite Count. Phase I by itself, when completed, would establish a community larger than Drummond. The end result would be a new community with residential and commercial lots, its own fire, police and ambulance service, parks, postal services and its own school district." With all phases complete, the Ryan Creek subdivision would have included over 500 lots.
Hansen filed an appeal shortly after the county's denial and continued work on a destination amphitheater in the meantime. Yesterday's ruling throws the subdivision's future into serious question. The Granite County Commission issued a statement to the Indy late Friday afternoon that they are "very pleased by this ruling."
